Terms of the paulinajanik.pl website and of booking visits at Paulina Janik’s dietitian office in Suwałki. This is a translation; the Polish version is the binding one.

§ 1. General provisions

  1. These Terms set out the rules for using the paulinajanik.pl website (“the Website”), in particular online booking, the contact form and the nutrition intake form before a visit.
  2. The Website is run and the services are provided by Paulina Janik, ul. Innowacyjna 1, 1st floor, unit 22F, 16-400 Suwałki, Polish tax number (NIP) 7861737473 (“the Dietitian”). Contact: kontakt@paulinajanik.pl, phone 510 715 245.
  3. Orders from the online clinic are governed by the separate Online clinic terms.
  4. The processing of personal data is described in the Privacy policy, and the storage of information in your browser in the Cookie policy.
  5. These Terms are available free of charge on the Website in a form that allows them to be downloaded, saved and printed.

§ 2. Definitions

  • Patient: an adult who uses the Website, including booking a visit for themselves or, as a parent or legal guardian, for a child.
  • Visit: a dietary consultation at the office in Suwałki or remotely (by video or by phone), in the forms the Calendar offers for a given type of visit.
  • Calendar: the booking module on the Website that shows free slots.
  • Visit page: the page with the details of a particular visit, available through the personal link in the confirmation e-mail.
  • Intake form: the nutrition questionnaire the Patient may fill in before a visit.

§ 3. Technical requirements

  1. To use the Website you need a device with internet access, an up-to-date web browser and an e-mail address.
  2. A video visit requires a computer, tablet or phone with a camera, microphone and a stable internet connection; a phone visit requires a phone at the number given in the booking.
  3. The Patient may not send unlawful content through the Website or attempt to introduce harmful data (malware, viruses and the like) into the system.

§ 4. Booking a visit

  1. A visit can be booked in the Calendar at any time of day. The Patient chooses the type of visit, its form (at the office, by video or by phone, if that type of visit allows it) and a free slot, gives their name, e-mail address and phone number, and accepts these Terms. No account is needed.
  2. A visit for a child is booked by a parent or legal guardian, who gives their own details and the child’s.
  3. Depending on the Calendar settings, a booking is confirmed straight away or after the Dietitian approves it. In the first case the Patient receives an e-mail confirming the visit with a calendar file (.ics). In the second, the Patient first receives an e-mail that the request has been received, and then a confirmation or a message that the slot cannot be accepted; until then the slot is held for the Patient.
  4. The visit contract is concluded when the confirmation e-mail is sent.
  5. The confirmation e-mail contains a link to the Visit page, where the Patient can check the details, add the visit to a calendar, cancel or reschedule it and, before a first visit, fill in the Intake form.
  6. The Patient gives true details. If the details raise doubts or the booking looks automated, the Dietitian may ask for confirmation by phone or reject the booking.

§ 5. Cancelling and rescheduling

  1. With the button on the Visit page (link in the confirmation e-mail) a visit can be cancelled or moved to another free slot up to 24 h before it starts.
  2. After that, a visit can be cancelled or moved by phone or e-mail. Please get in touch as early as possible.
  3. The Dietitian may cancel or move a visit for important reasons (e.g. illness). The Patient is then informed by e-mail or phone and offered a new slot.
  4. Cancelling or moving a visit, including as described in point 2, involves no fees and does not limit the statutory rights of a consumer.
  5. A Patient who is a consumer may withdraw from a visit contract concluded at a distance within 14 days of concluding it, without giving a reason and at no cost: by cancelling the visit under points 1-2 or by sending a statement by e-mail or post (they may, but do not have to, use the model withdrawal form in Annex 2 to the Polish Consumer Rights Act of 30 May 2014). If the visit is to take place before that period ends, by booking it the Patient requests that the service starts before the withdrawal period ends. Once the service has been fully performed, i.e. after the visit has taken place, the right of withdrawal no longer applies (Art. 38(1)(1) of that Act).

§ 6. Missed visits and lateness

  1. If the Patient does not come to a visit (does not join a video visit or answer the phone) and has not cancelled it, the visit is marked as missed.
  2. After repeated missed visits without cancellation, the Dietitian may ask for phone confirmation of further bookings or stop accepting online bookings from that Patient.
  3. If the Patient is late, the visit ends at the scheduled time, so that other Patients do not have to wait.

§ 7. Video and phone visits

  1. The Patient will find the video visit link on the Visit page. The Dietitian also sends it by e-mail: in the confirmation or, if the link is not ready when the visit is confirmed, in a separate message before the visit. The button for joining the video call becomes active 15 minutes before the visit starts.
  2. A phone visit can be booked for the types of visit for which the Calendar offers it (e.g. the free consultation). The Dietitian calls the number given in the booking at the agreed time.
  3. If a video visit cannot take place for technical reasons, the Dietitian and the Patient may continue by phone or agree on a new slot at no extra cost.
  4. Visits are not recorded. The Patient may record a visit only with the Dietitian’s consent.
  5. The diet programme prepared after a remote visit is sent by post to the address given by the Patient.

§ 8. Prices and payment

  1. Visit prices are given in the price list on the Website. They are gross prices in Polish zloty. The price on the day of booking applies.
  2. A video visit costs the same as a visit of the same type at the office.
  3. The free consultation is free of charge and involves no obligation to continue.
  4. The Dietitian gives the payment details when confirming the visit. The Patient receives proof of purchase (a bill, receipt or invoice).
  5. Announcements, price lists and other information about services on the Website are an invitation to conclude a contract within the meaning of Art. 71 of the Polish Civil Code.

§ 9. Intake form and health data

  1. Before a visit the Patient may fill in the Intake form through the link in the e-mail. It is voluntary but helps prepare the visit.
  2. The Intake form can be completed and corrected until the visit starts; after that it is read-only.
  3. The Dietitian processes health data only on the basis of the Patient’s explicit consent, in line with the Privacy policy. Consent can be withdrawn at any time.
  4. Before using the services, the Patient should check with their doctor that there are no contraindications to following a diet. Dietary advice does not replace medical advice, diagnosis or treatment.
  5. The Dietitian may refuse to prepare a diet programme if it goes beyond her competence or raises doubts because of the Patient’s health. She will then inform the Patient and refund any payment made.
  6. A diet programme prepared by the Dietitian is for the Patient’s own use only and may not be passed on to third parties.

§ 10. Contact form

  1. The contact form is for questions. It is not for booking visits: visits are booked in the Calendar.
  2. Test results can be attached to a message: PDF, JPG or PNG files, up to 3 files, at most 8 MB each and 12 MB in total.
  3. The Dietitian answers messages personally, usually within one working day.

§ 11. Complaints

  1. The Patient may make a complaint if the services are not provided or are provided contrary to these Terms.
  2. Complaints can be sent by e-mail to kontakt@paulinajanik.pl or by post to the office address.
  3. A complaint should include the Patient’s details, e-mail address, the date the problem was noticed, a description of the problem and what the Patient requests.
  4. If a complaint needs more information, the Dietitian will ask the Patient to complete it before considering it.
  5. The Dietitian will respond to a complaint within 14 days of receiving it. No response within that time means the complaint is accepted.

§ 12. Copyright

  1. All photos and other materials (including texts, graphics and logos) on the Website are the property of the Dietitian or are used with the consent of their copyright holders.
  2. Copying photos and other graphics or reprinting texts from the Website requires the written consent of the Dietitian or another rights holder, except for permitted use under copyright law.

§ 13. Final provisions

  1. These Terms do not exclude or limit the rights of a Patient who is a consumer under mandatory provisions of law. If the Terms conflict with such provisions, the provisions prevail.
  2. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
  3. The Dietitian may change these Terms for important reasons, e.g. a change in the law or in how the Website works. Changes take effect no earlier than 7 days after they are published on the Website; visits booked earlier follow the previous rules.
  4. Disputes with consumers are settled by the common courts with jurisdiction under general rules. A consumer may also use out-of-court dispute resolution, e.g. the help of a municipal or district consumer ombudsman.
  5. These Terms apply from the update date shown at the top of the document.
